Pricing and Payment

Payment of your order is made at the point of placing the order. We accept payment with most types of credit and debit cards.
We will advise you if your payment details cannot be authorized for any reason. We will then arrange for payment to be made by another method.
Accounts
When you sign up and register to access some or all of our Service, you shall ensure that all information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
We recommend that you do not share your password with others. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.
You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization or consent.

ZENPULSAR shall own all intellectual property rights in relation to the Services including the APIs, all related manuals and any documentation, any copy, translation, modification, or adaptation of the software, or development based thereon, which may be created by or for ZENPULSAR or by or for you.
If by operation of law, you are deemed to possess any rights in such item, then you hereby assign such intellectual property right to ZENPULSAR. To the extent your rights are inalienable under applicable law, you hereby waive such rights and, if such waiver is invalid, grant ZENPULSAR the exclusive, irrevocable, perpetual worldwide, royalty-free, right to use, market, modify and grant licenses to such items without identifying you or seeking your consent.
Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of ZENPULSAR. Service is protected by copyright, trademark, and other laws.

The total cumulative liability of ZENPULSAR and its officers, directors, employees and agents together with its affiliates for all damages arising under or in connection with these Terms, any schedule, exhibit regardless of the form of action (including but not limited to, actions for breach of contract, tort (including negligence), strict liability, rescission, misrepresentation and breach of warranty) shall not in the aggregate exceed the fees actually paid by you to ZENPULSAR.
Third parties. These Terms are made solely between you and ZENPULSAR and are not intended for the benefit of any third-party whether or not identified herein. In no event ZENPULSAR shall be liable to you or any of your End User or any third-party under these Terms regardless of the form of the claim whether in contract, tort or otherwise. Such liability to any third party is expressly disclaimed and limited to the maximum extent permitted by applicable law for damage, whether direct, indirect, incidental, consequential, special, punitive, arising from the use of the Services.
Termination rights
ZENPULSAR may terminate this Agreement upon reasonable notice to you in the event ZENPULSAR determines, in its reasonable discretion, that any law, statute, regulation, rule, or operating procedure causes, or would potentially cause, the Services to fail to materially comply with such law, statute, regulation, rule or operating procedure, or any change in the applicable regulation relevant to the use of the Services materially affects ZENPULSAR ability to provide the Services.
Governing Law
These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed and construed in accordance with the laws of England and Wales.
